Terms of Service for UsersLast updated: 05.03.2025.By using the Order and Pay service provided by DOT YOUR SPOT d.o.o. (hereinafter referred to as "Dot"), you (hereinafter referred to as "User") agree to these Terms of Service ("Terms"). Please read the following Terms carefully before using the Order and Pay service (hereinafter reffered as „Order and Pay service/platform/system“), as they constitute a legally binding agreement between You and Dot. If You do not agree to these Terms, You are not authorized to use the service, as these Terms apply to every use of the Order and Pay service.
1. Definitions1.1. "Venue owner" refers to a legal entity or individual (or their legal substitute) that has entered into a business cooperation with Dot for its hospitality establishment and offers its products via Dot's Order and Pay service. Unless otherwise specified, all Venue owners are merchants within the meaning of applicable consumer protection laws.1.2. "User" or "You" refers to any individual who uses the Order and Pay service, and is required to adhere to all provisions of these Terms, as well as any other relevant documentation made available by Dot.1.3. "Dot" is a company, DOT YOUR SPOT d.o.o., based in the Republic of Croatia, which connects Users and Venue owners through its Order and Pay platform.
2. Description of the Order and Pay Service2.1. DOT YOUR SPOT d.o.o., headquartered in Split, Antuna Gustava Matoša 56, VAT: 93631185592, provides the Order and Pay software system. Order and Pay is an advanced platform offering an online sales point, enabling Users to order and pay for food, beverages, and/or other products at hospitality establishments using this system. The system is developed and maintained by Dot to improve the user experience and facilitate a fast, secure, and efficient interaction between hospitality establishments and their guests.2.2. By using the Order and Pay system, Users can:- browse menus and product offerings via the Order and Pay system
- order products online through their mobile devices without the need for physical interaction with the establishment's staff
- securely pay online using integrated payment systems (Mastercard, Maestro, Visa).
3. Purchase ConditionsGENERAL3.1. DOT YOUR SPOT d.o.o. provides the Order and Pay platform, which connects Users and Venue owners, allowing Users to order food, beverages, and/or other products from Venue owners at their location.3.2. Venue owners provide information about their products through the Order and Pay service, including but not limited to, pricing and product characteristics, allergens, and other relevant information. If you have allergies or need more detailed product information, you can contact the Venue owner at the establishment where you are located. You may also contact Dot's customer support, which will communicate with the Venue owner regarding any concerns or questions. Venue owners are solely responsible for providing accurate and legally required product information, including applicable pricing. Dot is merely the platform provider and has no responsibility for the characteristics, quality, or other product aspects.ORDERING AND PAYMENT3.3. When selecting products through the Order and Pay system, the User submits a purchase order for the selected items. Once the order is received, Dot will notify the Venue owner of the order details. The order is deemed confirmed when the User completes payment and the Venue owner accepts the order. The funds paid by the User are reserved until the Venue owner accepts the order, and the User receives a confirmation via Order and Pay on behalf of the Venue owner, after which the payment is finalized. If the Venue owner is unable to fulfill the order or rejects it for any reason, the reserved funds will be immediately released. Fulfillment of orders depends, but is not limited to, availability.3.4. Ordered products must be paid for immediately using one of the accepted cards (Mastercard, Maestro, or Visa). Dot charges Venue owners a platform fee for each order placed through Order and Pay, but this fee does not affect the final price of the products for the User. The use of the Order and Pay system is completely free for Users.3.5. In some cases, the final price paid by the User may slightly vary due to currency exchange rate differences as part of the payment process. Dot is not responsible for currency conversion discrepancies or other details related to payment processes.SECURITY OF CREDIT CARD PAYMENTS3.6. Online payments through Order and Pay are processed via Monri Online. User data confidentiality is protected and ensured by using the latest version of TLS encryption. Payment pages are secured by SSL protocol with 128-bit encryption. SSL encryption ensures secure data transfer, preventing unauthorized access during transmission. The Monri Online service and financial institutions exchange data using a virtual private network (VPN), protected from unauthorized access. The Monri Payment Gateway is certified under the PCI DSS Level 1 security standard required by Visa and Mastercard.We do not store credit card numbers, and they are not accessible to unauthorized individuals.DELIVERY3.7. The Venue owner at the establishment will prepare and serve the ordered products as specified. Dot is not responsible for the correct fulfillment of the order by the Venue owner but can facilitate compensation if approved by the Venue owner through their administrative interface. Any estimated delivery time provided to the User is merely an estimate, and there is no guarantee that the order will be served at the specified time. Delivery times depend on the workload of the establishment, and the average delivery time may vary accordingly.3.8. The User does not have the right to withdraw or cancel the order after submission unless otherwise stated in these Terms. Therefore, it is advised to carefully review your order before confirming it, as complaints will only be possible under specific circumstances defined in these Terms.COMPLAINTS3.9. Given the nature of hospitality services, complaints must be made immediately after receiving the order at the establishment. If the delivered product does not match the ordered product or if you are dissatisfied with the quality, please notify the responsible person at the establishment within 10 minutes of receiving the order. Complaints can be submitted through the Venue owner's administrative interface.Complaints are possible in the following cases:- defective or damaged products
- incorrectly delivered orders
- products that fail to meet basic hygiene standards.
For any issues related to the functionality of the Order and Pay system, you can contact us via email at support@dotyourspot.com. If your complaint is valid, the Venue owner may offer:- a replacement product that matches the specifications of the desired product at no additional charge;
- a refund equal to the value of the disputed product.
REFUNDS3.10. In the event of a refund, the payment will be made through the same payment method used during the order, within 14 days from the date of complaint confirmation, in accordance with Croatian consumer protection laws.NOTES3.11. It is possible that the Venue owner, or the responsible person within the establishment, may not be able to accept complaints if the products have been partially or fully consumed, except in cases of justified reasons such as hygiene or health concerns. This is entirely beyond Dot's responsibility. 4. User AccountsACCESS4.1. As a User, you are granted a limited, non-exclusive, non-transferable right to access and use Dot's Order and Pay service, subject to Dot's Privacy Policy, Terms of Service, and other relevant rules. ACCOUNT CREATION AND SECURITY4.2. To use the Order and Pay system, the User must create an account by following the system's registration process.4.3. If there is any suspicion that an unauthorized person has gained knowledge of the User's account information, the User must immediately notify Dot. The User will be held responsible for any use of the Order and Pay service under their account, regardless of the circumstances.DATA COLLECTION, PROCESSING, AND USE4.4. To use the Order and Pay service, you are required to provide your personal information and valid card details for payment. Dot handles and uses the provided data as defined in its Privacy Policy, which is available on Dot’s website. Notably, Dot does not store any payment method information, as payment processing is managed by the payment service provider Dot uses. 4.5. DOTYOURSPOT d.o.o. is the controller of the User’s personal data collected by Dot, unless otherwise stated. All collected data will be processed in accordance with the Privacy Policy available on Dot's website. STATEMENT ON DATA PROTECTION AND COLLECTION4.6. We commit to protecting User's personal data by:- collecting only the necessary, basic data required to fulfill our obligations
informing Users about how their data is used, including through our Privacy policy - regularly offering options for data use, including whether Users wish their names to be removed from marketing campaign lists.
All User data is strictly protected and accessible only to employees who need it for their work. All our employees and business partners are responsible for adhering to privacy protection principles.ACCOUNT USAGE RESTRICTIONS4.7. Users may not use their account for illegal activities, including but not limited to fraud, malware distribution, phishing, or copyright violations. Dot reserves the right to suspend or permanently terminate an account at any time for violating the Terms of Service, system abuse, or behavior that endangers other users, the system, and/or the hospitality venue.4.8. Order and Pay enables Users to order alcoholic beverages through the system. In accordance with the applicable hospitality law, it is strictly prohibited to serve or permit the consumption of alcoholic beverages by individuals under the age of 18 within the hospitality establishment. Therefore, we emphasize that the Venue owner assumes full responsibility for verifying the legal age of the guest who has ordered a product containing alcohol. As a responsible company, we are committed to complying with legal regulations and encourage our Users to adhere to this rule.ACCOUNT TERMINATION4.9. Users have the right to request account closure and deletion at any time. After deletion, some data may be retained in the system in compliance with legal requirements. For any relevant information and assistance, please contact support@dotyourspot.com. 5. Intellectual property rights5.1. Intellectual property rights and all other rights related to the Order and Pay service, including all associated documentation, components, and copies, are exclusively owned by Dot and its affiliated companies. Dot is authorized to transfer any or all of its rights and obligations, in whole or in part, to an affiliate, successor company, buyer, or acquirer of business assets related to the Order and Pay system, without the prior consent of the User.5.2. Intellectual property rights referred to in section 5.1 include, but are not limited to, copyrights, patents, industrial designs, trademarks, trade secrets (including business strategies and methods), know-how, databases, and any other form of registered or unregistered intellectual property rights.5.3. Dot will continually develop the Order and Pay system, and therefore it will be subject to ongoing changes or the removal of different parts, including content and products, which the User consents to by agreeing to these Terms of Service.5.4. The hospitality venue, within its administrative interface of the Order and Pay system, may update its product information, delete or add new products. Consequently, the User may encounter information in the Order and Pay system that may be inaccurate, outdated, illegal, and/or harmful. Dot is not the author of the content and information provided by the hospitality venue in the system, so please refrain from holding Dot responsible for any damage resulting from the use or reliance on such information.
6. Duration and termination6.1. These Terms of Service come into effect on the date the User accepts them and remain in effect as a binding contract between Dot and the User for as long as the User uses Dot's services, which they can stop using at any time without any consequences.6.2. The User may terminate this agreement at any time without stating a reason by deactivating or deleting their user account. Termination of the agreement will not affect any obligations of the User that arose before the termination date.6.3. Dot, as mentioned earlier, reserves the right to temporarily or permanently suspend or terminate the User’s account at any time without prior notice in cases that may include violations of these Terms, unauthorized use, or actions by the User that compromise the security of the system and/or other users.
7. Final provisions7.1. These Terms of Service are governed by the laws of the Republic of Croatia and will be interpreted in accordance with Croatian law.7.2. Dot commits to resolving any disputes arising from its relationship with the User amicably. However, if disputes arise in connection with these Terms of Service, they will be resolved by the competent courts of the Republic of Croatia under Croatian law. However, the User, as a consumer, may initiate proceedings before the competent court of their residence.7.3. These Terms of Service are subject to changes to ensure compliance with the latest legal provisions, so Users are advised to review them frequently.7.4. Dot will publish any updated Terms of Service on this page, and the User will be informed of the change by the modification of the last update date visible at the bottom of these Terms of Service. If the User does not agree to the modified Terms of Service, they must cease using the Order and Pay service.
